James W. Martin earned his undergraduate and law degrees from Stetson University, which later awarded him the Ben C. Willard Award for humanitarian achievements and, in 2013, inducted him into the Stetson Law Hall of Fame. Since 2009 he has taught contract drafting and law practice management as an Adjunct Professor of Law at Stetson University College of Law, while continuing his own law practice. Since 2015 he has been Board Certified as an expert in Real Estate Law by The Florida Bar.
For 49 years his legal practice areas have been real property, wills, trusts, probate estates, corporations, nonprofits, construction, employment, intellectual property, and business law. And he has achieved the highest attorney ratings on Justia, Martindale, Lawyers, Avvo, and Super Lawyers.
Jim has written thirteen books and published over thirty articles on real estate, probate, corporations and other business organizations, contracts, legal management, legal forms, and nonprofit organizations. He received The Florida Bar’s Barbara Sanders Memorial Writing Competition Award for his article Fifty Tips for Writing the Contract That Stays Out of Court. His books on real estate transactions, business organizations, specialized forms, and nonprofit organizations were published over a period of twenty years by West Publishing (Thomson-Reuters) and comprise over 5,000 pages of legal forms.
He served for six years on The Florida Bar Probate Rules Committee and two terms as chair of the St. Petersburg Bar Association Probate Section. He was the first St. Petersburg attorney to e-file probate pleadings under a pilot program established by the probate court.
Jim Martin began working as a law clerk fifty years ago in a small St. Petersburg, Florida law office while attending Stetson College of Law. He researched law and drafted wills, trusts, articles of incorporation, leases, and contracts. He became a partner in that office after graduating. He drafted hundreds of wills and living trusts, handled real estate closings as a title insurance agent for Lawyers Title, litigated construction contract claims and liens, and formed and advised businesses and nonprofit corporations.
As a young attorney in 1980, Jim Martin read the Wall Street Journal article “U.S. Art World Dillydallies over Dalis”, which described the search by the Morse family for a permanent home for their collection of Salvador Dali paintings then located in Cleveland. After reading the article, Jim contacted the Morses and suggested St. Petersburg as the permanent home for the Dali Museum, which led to the state and local effort that resulted in the 1982 opening of the Salvador Dali Museum in St. Petersburg. Jim Martin remains an officer and trustee of the Dali Museum.
Jim has volunteered with more than twenty community organizations, served on the St. Petersburg City Council in 1982, and represented St. Petersburg on the Tampa Bay Regional Planning Council and the Pinellas County Arts Council. He helped launch Stetson’s Constitution Hall exhibit at the Stavros Institute’s Finance Park in Pinellas County to teach middle school students about their constitutional rights and the U.S. government.
Jim Martin was an early adopter of technology in the practice of law. Having worked as a computer programmer while attending Stetson, a skill he learned as a Georgia Tech / Defense Department co-op student, he knew the value of computers and introduced them as productivity tools in his law office before the advent of personal computers. In the early 1980s, he applied systems techniques to forming corporations and self-published the book Florida Corporations System, which was later published by West Publishing as its first electronic publication.
When advances in technology made a paperless law office possible, Jim’s office completed the conversion of its files from paper to electronic files by 2010, and most work was being done remotely by 2012. When the coronavirus pandemic arrived in 2020, Jim already had a virtual, paperless law office.
