Florida Again Requires Publishing Fictitious Names in Newspapers

Florida requires anyone who transacts business under a name different from the legal name to register it as a fictitious name. This is not the same as registering a trademark. It is separate and distinct registration. And ever since 2001 it was not necessary to publish a notice in a newspaper. All you had to do was file a registration application with the Florida Division of Corporations.

But the Florida Legislature in 2009 amended the law so it is required again that a notice of intention to engage in business under a fictitious name must be published in the newspaper.  See Florida Statutes Section 865.09.
